1. Scope These terms apply to all orders placed through this website with Artem Pohrebniak, Gasteigergasse, 1, 1200, Vienna, Austria. The contract language is English. Austrian law applies, without prejudice to the mandatory consumer protection rules of the country in which you have your habitual residence.

2. The artworks Every original artwork offered here is a unique, hand-made piece. Colours may appear slightly different on screen depending on your display, and small irregularities in brushwork, texture and edges are part of a hand-painted work rather than defects.

3. Conclusion of contract The presentation of artworks on this site is not a binding offer. By clicking the order button you make a binding offer to purchase. The contract comes into effect when I confirm your order by email or dispatch the artwork.

4. Prices and payment All prices are in euros. As a small business owner (Kleinunternehmer) under §6 Abs. 1 Z 27 UStG, I do not charge VAT. Shipping costs are shown separately before you complete your order. Payment is made through the payment methods offered at checkout.

5. Delivery Artworks are dispatched within 5 business days of receiving payment, unless stated otherwise in the item description. Delivery times given on product pages are estimates, not guaranteed dates. Risk of loss or damage passes to you when the artwork is handed over to you, except where you commissioned the carrier yourself.

For deliveries outside the EU, import duties, taxes and customs handling fees may be charged on arrival and are payable by you, unless agreed otherwise in writing before the order.

6. Right of withdrawal If you are a consumer, you have a right of withdrawal.

7. Warranty Statutory warranty rights under Austrian law apply. Characteristics described in section 2 as inherent to hand-made work do not constitute defects.

8. Copyright All copyright and reproduction rights in the artworks remain with me as the artist. Purchasing an artwork transfers ownership of the physical object only; it does not transfer any right to reproduce, publish commercially or create derivative works. Private display and non-commercial photography of your own artwork are of course permitted.

9. Certificate of authenticity Each original artwork is delivered with a signed certificate of authenticity stating the title, dimensions, medium and year.
